1. Accepting these terms

These Terms of Use (“Terms”) are an agreement between you and GurVer INC (“GurVer INC”, “we”, “us”) for TruckPro Safety Carma (“TruckPro”), including our website, web dashboard, iOS and Android apps, and text messages (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you use the Services for a company, you confirm that you are authorized to accept these Terms for it, and “you” includes that company. You must be at least 18 years old.

2. The Services

TruckPro shows a motor carrier’s public safety information from FMCSA and the U.S. Department of Transportation, explains it in plain language, and provides a TruckPro score, inspection evidence, fleet and driver views, team access and optional alerts. Features may change, and some are available only on the web or only in the app.

3. Safety data and the TruckPro score

  • Not affiliated with the government. TruckPro is not affiliated with, endorsed by, or acting for FMCSA or the U.S. DOT.
  • The TruckPro score is our own summary. It is not an FMCSA safety rating, a safety fitness determination, a BASIC percentile, or a prediction of enforcement action, insurance pricing or business outcomes.
  • Estimates are labeled. Some percentiles are TruckPro estimates computed from public data, using the methodology described in the FMCSA SMS Methodology. They may differ from the values FMCSA shows you when you sign in to its portal.
  • Source data can be wrong or late. Government data may contain errors, omissions or delays. We do not create or correct it. Use FMCSA’s DataQs process to dispute government records.
  • Informational only. The Services are not legal, regulatory, safety-compliance, insurance or financial advice. You remain responsible for complying with all laws and regulations that apply to your operations.

4. Accounts and organizations

  • Provide accurate information and keep your password confidential. You are responsible for activity under your account. Tell us right away about any unauthorized use.
  • You may register only a USDOT number that you own or are authorized to act for. We may ask for verification and may suspend access to a USDOT number when ownership is disputed.
  • Organization owners control who is invited to their organization and are responsible for their members’ use of the Services.
  • TruckPro staff may view an account in read-only mode to provide support and keep the Services secure.

5. Beta access and fees

The Services are currently offered as a private beta. Registration requires an invite code, which is single-use, tied to one USDOT number, and may not be sold or transferred. Beta features may be incomplete, changed or discontinued. If we introduce paid plans, we will tell you the price and terms in advance, and you will not be charged unless you agree.

6. Acceptable use

You agree not to:

  • access accounts, organizations or USDOT numbers you are not authorized for, or impersonate anyone;
  • scrape, bulk-download, resell or redistribute the Services or their data, except for your own carrier’s business use;
  • use the Services to harass, discriminate against or make unlawful decisions about any person;
  • probe, overload or interfere with the Services, or bypass security or rate limits;
  • reverse engineer the Services except where the law permits it;
  • use the Services in violation of any law, including privacy, consumer protection and export laws.

7. Text messages

If you opt in to TruckPro text messages, the SMS Terms apply and are part of these Terms. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Consent to receive text messages is not a condition of using the Services or of any purchase. Carriers are not liable for delayed or undelivered messages.

8. Ownership and feedback

The Services, including software, design, text, the TruckPro score methodology and trademarks, are owned by GurVer INC or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your internal business purposes under these Terms. Public government data remains public. If you send us feedback, we may use it without obligation to you.

9. Mobile apps and app stores

If you download a TruckPro app from the Apple App Store or Google Play, you also agree to that store’s terms. For apps obtained from Apple:

  • These Terms are between you and GurVer INC only, not Apple. GurVer INC, not Apple, is solely responsible for the app and its content.
  • Your license is limited to using the app on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • GurVer INC, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
  • GurVer INC, not Apple, is responsible for investigating, defending, settling and discharging any claim that the app infringes a third party’s intellectual property rights.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Suspension and termination

You may stop using the Services and delete your account at any time. We may suspend or end your access if you violate these Terms, if required by law, or to protect the Services or other users. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity and governing law.

11. Disclaimers

The Services and all data are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. GurVer INC does not warrant that government data, percentile estimates or the TruckPro score are accurate, complete or current.

12. Limitation of liability

To the maximum extent permitted by law, GurVer INC and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, loads, contracts, insurance coverage or data, arising from or related to the Services, even if advised of the possibility. Our total liability for any claim related to the Services will not exceed the greater of the amount you paid us for the Services in the 12 months before the claim, or one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnity

You will defend and indemnify GurVer INC against third-party claims arising from your misuse of the Services, your violation of these Terms, or your violation of law or of anyone’s rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Before filing a claim, please contact us at [email protected] so we can try to resolve it informally within 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Illinois, and you and we consent to their jurisdiction. Either party may bring an individual claim in small claims court.

15. Changes to these Terms

We may update these Terms. We will post the new version here with a new “last updated” date and, for material changes, notify you by email or in the app before they take effect. If you keep using the Services after changes take effect, you accept the updated Terms.

16. General

These Terms, the Privacy Policy and the SMS Terms are the entire agreement between you and us about the Services. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
